A divorced man who lost his marriage to his wife has sued the California judge who ordered his divorce.
Lawyers for Kevin Denton filed the lawsuit in federal court in Los Angeles Friday.
The lawsuit alleges the judge violated his constitutional right to due process by withholding his divorce from him and imposing a gag order on him.
In a filing in California Superior Court, lawyers for Denton said the gag order violated his right to free speech, equal protection and due process rights.
In his divorce petition, Denton accused the judge of violating the constitutional rights of his ex-wife by denying him a divorce while holding a gag on him and threatening to withhold an order of divorce unless she agreed to a settlement.
Denton said in the filing that he was “furious” at the judge for her behavior.DENTON: I AM FURIOUS AT THE COURTROOMS ORDERING ME TO DEAL WITH THIS DEBATE, BUT THINK IT IS A CRIME TO ME TO COMPLAIN ABOUT A FRAUD AND FORGERY.
DENTON FILES DECLARATION OF FRAUGHTS BY THE LA COUNTY JAILER AND REQUEST FOR AN END TO THE GAG ORDER.
The judge’s lawyers, however, said the order was an order for Donton to comply with a gag.DONTON: THEY ARE JUST GOING TO GAG ME AND MAKE ME GO INTO SUITORS HALL TO FILE FOR DISMISSAL.
The only way I can get a divorce is if they take me to mediation, and if they do that I am going to file for divorce, and that’s it.
The filing says the judge did not order Dontons removal of the gag.
The suit says the gag has been in effect since March.
